Spammer Damages

While lawyers moan about e-mail boxes full of spam, Gordon Dick has extricated himself from his computer desk, strolled to the Edinburgh Sheriff Court, issued a small claims summons and gained a judgment for £1,300 in damages and costs. Frankly, it makes the rest of us look a bit slack.


It is an unusual story in many ways: the spammer was identifiable, within the UK and seems to have argued instead of putting things right. But the case it does show that, just occasionally at least, the various legislation and directives can hit the spot.


On his ‘Scotch Spam’ web site, Gordon Dick is actively encouraging more people to follow his example and that of Nigel Roberts, who brought similar action in the English courts in 2005.
