An afternoon of workshop sessions consisting of case studies and role play in respect of the following topics:

International Transfers
Our case study on international transfers will look in detail at a scenario involving a multinational corporation looking to put in place a centralised HR database for all its divisions.  We will look at the following:
• What questions lawyers and DP officers need to ask of their HR and IT colleagues
• Understanding the jurisdictional issues
• Understanding the position of the ICO and other EU DP regulators
• The different options for ensuring Eighth Principle compliance
• The impact of outsourcing of the DP issues


Employment and HR
In this section of the seminar we will cover a wide variety of the most common situations in which employers come unstuck, including:
• Exactly when information relating to an individual is and  importantly is not “personal data” under the Act
• Employees’ rights of access to performance appraisal information and any duty of confidentiality owed to the appraisers
• How to legitimately screen employees for illegal drug use and alcohol dependency, intercept and monitor the content of an employee’s personal emails; how to use and disclose these types of information in accordance with the Act, the common law of confidentiality and the relationship of mutual trust and confidence which should exist between employees and employers.


Marketing and Promotions
A role play which will enable us to consider: sharing data with third parties; placing fair processing notices behind hypertext links; obtaining consent to electronic marketing (including the use of opt outs to obtain consent); change of purpose and much, much more!
