The Electronic Identification and Trust Services for Electronic Transactions (Amendment etc.) (EU Exit) Regulations 2019

The Electronic Identification and Trust Services for Electronic Transactions (Amendment etc.) (EU Exit) Regulations 2019 have been have been made. The Regulations will apply to the whole of the UK and amend provisions deriving from Regulation (EU) No 910/2014 on electronic identification and trust services for electronic transactions. The law is retained in domestic law under the European Union (Withdrawal) Act 2018.

The explanatory memorandum explains that in respect of electronic identification, the UK will not have access to the interoperability framework for electronic identification provided by Regulation 910/2014 after it has left the EU. The draft Regulations repeal the electronic identification aspects as they will not be relevant once the UK leaves the EU, but retain the trust services, which are services relating to electronic signatures, electronic seals, timestamps, electronic delivery services, and website authentication.
